Terms of Service

By using Book Your Calendar ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not use our platform. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting.

1. Service Overview

Book Your Calendar is a SaaS platform designed to facilitate seamless meeting scheduling. Our service allows users to book, manage, and integrate meetings effortlessly with their preferred calendar and video conferencing tools.

The platform is intended for businesses and professionals looking for an efficient way to manage their appointments and meetings.

2. User Responsibilities

Users are responsible for providing accurate information, maintaining the security of their accounts, and complying with all applicable laws when using our services.

Users must not:

• Use the service for spam, fraudulent, or malicious purposes
• Misrepresent their identity or affiliations
• Violate any data privacy regulations or rights of other users

3. Data Privacy and Security

We take user privacy seriously. All personal data is handled according to our Privacy Policy, and we implement security measures to protect user information.

However, users are responsible for safeguarding their credentials and should report any unauthorized access immediately.

4. Payment and Subscription

Book Your Calendar may offer both free and paid plans. Paid plans grant users access to premium features and are billed according to the chosen subscription model.

Subscription Cancellation: Users can cancel their subscription at any time. Upon cancellation, access to paid features stops immediately. No refunds will be provided for the current billing period unless a platform bug is not fixed within 7 days of reporting.

Payment Processing: Book Your Calendar (BYC) is not a payment gateway. All financial transactions, refunds, chargebacks, and disputes are securely handled by Razorpay. BYC only facilitates scheduling-related payment workflows between users. Razorpay is responsible for all payment processing, transaction disputes, and financial matters.

Free Users: Free users are not eligible for refunds as the service is provided at no cost.

5. Account Termination and Data Deletion

Account Termination: You may terminate your account at any time by using our account deletion API (/api/users/delete) or by contacting us at bookyourcalendar@gmail.com.

Team Owner Restrictions: Team owners cannot delete their account until they transfer ownership to another team member or delete the team. This is to prevent data loss for team members.

Data Deletion Options: When deleting your account, you can choose:

• Anonymization (Soft Delete): Removes all personally identifiable information (PII) while retaining transaction data for financial record-keeping (required by tax laws).
• Hard Delete: Complete removal of all your data. Note: Financial records may still be retained for 7 years as required by tax authorities.

Data Retention: Some data may be retained after account deletion:

• Payment and billing records: 7 years (tax compliance requirement)
• Audit logs: 7 years (security compliance requirement)
• Anonymized transaction data: For financial record-keeping

Termination by Us: We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk. We will provide notice when possible, except in cases of immediate security threats.

6. Limitation of Liability

Book Your Calendar is not liable for any indirect, incidental, or consequential damages arising from the use of our service. We do not guarantee uninterrupted access and are not responsible for third-party service failures.

Service Availability: While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We are not liable for service interruptions, downtime, or data loss due to:

• Third-party service failures (Clerk, Razorpay, Vercel, MongoDB Atlas)
• Network outages or internet connectivity issues
• Force majeure events (natural disasters, acts of war, etc.)
• Maintenance windows or system updates

User Disputes: Book Your Calendar is not responsible for disputes between users (e.g., service provider vs customer). All disputes related to meetings, services, or payments between users must be resolved directly between the parties involved.

Payment Disputes: All payment-related disputes, chargebacks, and refund requests must be handled through Razorpay, as they are the payment processor responsible for all financial transactions. We are not responsible for payment processing issues, refund delays, or chargeback decisions.

Maximum Liability: Our total liability for any claims arising from your use of our service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

7. Intellectual Property

Our Intellectual Property: All content, features, and functionality of Book Your Calendar, including but not limited to text, graphics, logos, icons, images, and software, are owned by Book Your Calendar and are protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of all content you create, upload, or share through our service (events, bookings, portfolio content, etc.). By using our service, you grant us a limited, non-exclusive, worldwide license to use, store, and display your content solely for the purpose of providing our services to you.

User-Generated Content: You are responsible for ensuring you have the right to use and share any content you upload. You agree not to upload content that infringes on the rights of others, including copyright, trademark, privacy, or publicity rights.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

GDPR / DPDP: We implement data protection controls in accordance with the General Data Protection Regulation (GDPR) and the Digital Personal Data Protection Act (DPDP) of India. You have the right to:

• Access your personal data (via /api/users/export-data)
• Request deletion of your data (via /api/users/delete)
• Rectify inaccurate data
• Object to processing of your data
• Data portability

Data Security: We implement industry-standard security measures to protect your data, including encryption, access controls, and regular security audits. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be notified to you via email or through a prominent notice on our website. Your continued use of our service after such modifications constitutes acceptance of the updated terms.

Effective Date: The "Last Updated" date at the top of this page indicates when these terms were last revised. We encourage you to review these terms periodically.

Disagreement with Changes: If you do not agree with any modifications to these terms, you must stop using our service and may delete your account.

10. Governing Law and Dispute Resolution

Governing Law: These Terms of Service are governed by the laws of India, without regard to its conflict of law provisions.

Dispute Resolution: Any disputes arising from these terms or your use of our service shall be resolved through:

• Informal Resolution: We encourage you to contact us first to resolve any disputes informally.
• Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India.
• Jurisdiction: The courts of India shall have exclusive jurisdiction over any disputes not subject to arbitration.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.
